According to local sources, each producer must register with Pirkanmaa Regional Environmental Center (Producer Register) or join producers compliance schemes to comply with the Waste Law (Ordinance on EE Waste - 852/2004). Deadline for registering was May 15, 2005.
Only legal entities in Finland can register due to lack of possibility to apply Finnish legislation to any foreign companies without a legal representative in Finland. Only companies with Finnish business code (Y-code) can register. So as a general rule, only Finnish branch office or importer of the products to Finland can and has to register.
If a foreign company sells equipment directly to the end user of the product without any local company involved, the end user is considered as an importer. In that case, the foreign company can take the responsibility on behalf of the end user by joining one of the existing compliance schemes ([www.elker.fi], [www.serty.fi], [www.nera.fi]), which then acts as a legal entity. Please note, that it is not possible to do this on behalf of a Finnish importer of the products or a local subsidiary.
Registering has to be made either in Finnish or Swedish, the two official languages. Registering formats can be found from Pirkanmaa Regional Environment Center's Finnish and Swedish web pages (http://www.ymparisto.fi). The forms should be sent in paper format. Pirkanmaa Regional Environment Center cannot accept electronic forms, because due to the legislation, they need the original signed application. Pirkanmaa Regional Environment Center serves their customers in Finnish, Swedish, German and English. Therefore, it is possible to send additional information in English.
At present, the registration fee for an individual producer is 390 Euros and for compliance scheme 1,400 Euros. Membership fees for compliance schemes vary according to the scheme.

Elker Oy is an organization founded in March 2004 for the purpose of organizing the collection and recycling of electrical and electronic equipment waste. The organization produces administrative, agency, comparisons to find the most profitable choice, statistics, reporting, etc. services to producers' entities who own the organization.
